Wisconsin Bingo Laws

Whoever does any of the following is guilty of a Class B misdemeanor: (1) Makes a bet; or (2) Enters or remains in a gambling place with intent to make a bet, to participate in a lottery, or to play a gambling. (3) Conducts a lottery, or with intent to conduct a lottery, possesses facilities to do. For taxpayers that are Wisconsin residents, gambling income has a situs in Wisconsin regardless of where the gambling activity takes place. For taxpayers that are nonresidents, gambling income has a situs in Wisconsin if the net winnings are derived from any of the following:. A casino or bingo hall located in Wisconsin and operated by a Native American tribe or band. Pari-mutuel wagering paid by a Wisconsin.

Regular bingo game: means a bingo game in which a person, upon payment of an admission, is issued a regular bingo card and may purchase or rent extra regular cards.   • Adult: means a person who has attained the age of 18 years, except that for purposes of investigating or prosecuting a person who is alleged to have violated any state or federal criminal law or any civil law or municipal ordinance, 'adult' means a person who has attained the age of 17 years.   • Adult family home: has the meaning given in…. See Wisconsin Statutes 563.03
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is 'to appeal' or 'to take an appeal.' One who appeals is called the appellant.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Bingo: as used in this chapter shall not mean any game using free cards and donated prizes, if any, for which no payment of consideration is made by participants. See Wisconsin Statutes 563.03
  • Bingo occasion: means a single gathering or session at which a series of successive bingo games is played. See Wisconsin Statutes 563.03
  • Bingo supplies and equipment: means all cards, boards, sheets, markers, pads or other supplies, devices or equipment designed for use in the play of bingo. See Wisconsin Statutes 563.03
  • Calendar: means a table or register of days covering not less than one nor more than 12 calendar months that entitles the purchaser to one entry in each drawing in a calendar raffle. See Wisconsin Statutes 563.03
  • Calendar raffle: means a raffle for which a drawing is held and a prize awarded on each date specified in a calendar. See Wisconsin Statutes 563.03
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • Community-based residential facility: has the meaning given in…. See Wisconsin Statutes 563.03
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the department of administration. See Wisconsin Statutes 563.03
  • Division of gaming: means the division of gaming in the department. See Wisconsin Statutes 563.03
  • Drawing: means any of the following methods for determining a winner of a game of chance:
(a) Random selection of a ticket portion or calendar portion from a container housing portions of all tickets or calendars purchased for the selection. See Wisconsin Statutes 563.03
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Extra regular card: means a nondisposable card which affords additional opportunities to play in a regular bingo game to be played at a bingo occasion. See Wisconsin Statutes 563.03
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Following: when used by way of reference to any statute section, means the section next following that in which the reference is made. See Wisconsin Statutes 990.01
  • Gambling place: has the meaning designated in…. See Wisconsin Statutes 563.03
  • Gross receipts: means total receipts received from the conduct of bingo including, but not limited to, receipts from the sale, rental or use of regular bingo cards, extra regular cards, special bingo cards and bingo supplies. See Wisconsin Statutes 563.03
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • in writing: includes any representation of words, letters, symbols or figures. See Wisconsin Statutes 990.01
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Licensed organization: means an organization licensed under this chapter to conduct bingo. See Wisconsin Statutes 563.03
  • Limited period bingo: means the conduct of bingo for a period of not more than 4 out of 5 consecutive days in any one year at a festival, bazaar, picnic, carnival or similar special function conducted by a licensed organization. See Wisconsin Statutes 563.03
  • Minor: means a person who has not attained the age of 18 years, except that for purposes of investigating or prosecuting a person who is alleged to have violated a state or federal criminal law or any civil law or municipal ordinance, 'minor' does not include a person who has attained the age of 17 years. See Wisconsin Statutes 990.01
  • Month: means a calendar month unless otherwise expressed. See Wisconsin Statutes 990.01
  • Officers: when applied to corporations include directors and trustees. See Wisconsin Statutes 990.01
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: includes all partnerships, associations and bodies politic or corporate. See Wisconsin Statutes 990.01
  • Preceding: when used by way of reference to any statute section, means the section next preceding that in which the reference is made. See Wisconsin Statutes 990.01
  • Premises: means any room, hall, enclosure, tent, or outdoor area in which bingo is being played. See Wisconsin Statutes 563.03
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Profit: means the gross receipts collected from one or more bingo occasions, less reasonable sums necessarily and actually expended for bingo supplies and equipment, prizes, utilities, license fees and taxes. See Wisconsin Statutes 563.03
  • Progressive jackpot bingo: means a series of bingo games in which the prize is carried over to the succeeding game if no player wins a game within a specified number of calls. See Wisconsin Statutes 563.03
  • Promulgate: when used in connection with a rule, as defined under…. See Wisconsin Statutes 990.01
  • Proper and legitimate expenditure: means an expenditure made by an organization for any of the following:

    (a) Any purpose for which the organization is organized. See Wisconsin Statutes 563.03
  • Property: includes real and personal property. See Wisconsin Statutes 990.01
  • Qualified: when applied to any person elected or appointed to office, means that such person has done those things which the person was by law required to do before entering upon the duties of the person's office. See Wisconsin Statutes 990.01
  • Raffle: means a game of chance for which tickets or calendars are sold and one or more drawings for prizes are held, but does not include a savings promotion program under…. See Wisconsin Statutes 563.03
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • real property: includes lands, tenements and hereditaments and all rights thereto and interests therein. See Wisconsin Statutes 990.01
  • Regular bingo card: means a nondisposable card issued to a person upon payment of the admission fee which affords a person the opportunity to participate in all regular games played at a bingo occasion. See Wisconsin Statutes 563.03
  • Regular bingo game: means a bingo game in which a person, upon payment of an admission, is issued a regular bingo card and may purchase or rent extra regular cards. See Wisconsin Statutes 563.03
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Senior citizen community center: means a public place in which recreational or social activities are made available primarily to individuals who are 55 years of age or older. See Wisconsin Statutes 563.03
  • Special bingo card: means a disposable, specially marked bingo card which affords a person the opportunity to participate in a special bingo game to be played at a bingo occasion. See Wisconsin Statutes 563.03
  • Special bingo game: means any bingo game which is not a regular bingo game and which is played with special bingo cards. See Wisconsin Statutes 563.03
  • State: when applied to states of the United States, includes the District of Columbia, the commonwealth of Puerto Rico and the several territories organized by Congress. See Wisconsin Statutes 990.01
  • Subpoena: A command to a witness to appear and give testimony.
  • Sworn: includes 'affirmed' in all cases where by law an affirmation may be substituted for an oath. See Wisconsin Statutes 990.01
  • Tenancy in common: A type of property ownership in which two or more individuals have an undivided interest in property. At the death of one tenant in common, his (her) fractional percentage of ownership in the property passes to the decedent
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Ticket: means an instrument that entitles the purchaser to one entry in a raffle other than a calendar raffle. See Wisconsin Statutes 563.03
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Year: means a calendar year, unless otherwise expressed; 'year' alone means 'year of our Lord'. See Wisconsin Statutes 990.01
  • The Badger State has most major forms of gambling, though online gambling exists in an unregulated environment. Wisconsin has 25 different tribal casinos, most of them owned and operated by the Ho-Chunk, Oneida, St. Croix, Potawatomi, and Menominee nations. The bulk of these are smaller venues, but casinos like the Potawatomi Hotel & Casino in Milwaukee are large and have thousands of slot machines.
